Relocation/Leave to Remove

Relocation/Leave to Remove

IF YOU ARE HOPING TO RELOCATE WITH YOUR CHILD/REN YOU WILL REQUIRE THE CONSENT OF THE OTHER PARENT WHO HOLDS PARENTAL RESPONSIBILITY OR, ALTERNATIVELY, APPLY TO COURT FOR ‘LEAVE TO REMOVE’.

When considering a relocation application, the court will consider what is in the best interest of a child/ren. If you are applying to the court for relocation/leave to remove, it is vital that you have considered your plans both now, and in the future, plans for contact with the other parents, educational needs etc. Your plans need to be reasonable and persuasive for a court to consider approving your application.

We are here to support you in negotiating the consent of the other parent or in making and supporting you with an application to court if consent is not provided.

If more than one reason applies, we will advise you on the most appropriate for your application.

If you need advice regarding relocation for your child/ren then please do not hesitate to contact us at either our Hythe or Ashford offices or by email to our Family Chartered Legal Executive at or call her on 01303 233 529.
