Separation agreements are used to set out how parties’ finances and/or child arrangements will be arranged once they have separated. The reason for a separation agreement is so that upon divorce/dissolution, the agreement can be used to evidence the agreement reached.
Separation agreements can cover a range of areas such as, the split of the finances, how and who will pay the mortgage and/or bills, if a party is going to pay any spousal or child maintenance to the other, how the child arrangements will work, who the child/ren will live with etc.
To ensure a separation agreement is as strong as it can be ahead of a divorce/dissolution, both parties should obtain legal advice on its contents.
